Welcome to Legend Marketing ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website located at www.legend-marketing.com (the "Site") and the digital marketing, funnel creation, and ad management services provided by Legend Marketing (the "Services").

By accessing the Site or purchasing our Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Site or Services.

1. Services Provided

Legend Marketing provides digital marketing services, including but not limited to, paid advertising management (Meta, Google, etc.) and funnel/landing page design and creation.

The specific scope of work, deliverables, and timelines for any project will be outlined in a separate, mutually agreed-upon Service Agreement or Proposal.

2. Fees and Payments

2.1 Setup Fees
For Services involving, but not limited to funnel or landing page creation, a one-time setup fee is required. Work will not begin on any strategic assets, copywriting, or development until the setup fee is paid in full.

2.2 Monthly Retainers
Paid advertising management is billed on a recurring monthly retainer basis. Retainer fees are billed after the service month.

2.3 Advertising Spend
All traffic and advertising budgets (Ad Spend) are paid directly to the respective advertising platforms (e.g., Meta, Google) by the Client. Legend Marketing’s fees are strictly for the management and creation of the assets and campaigns. The Client must maintain a valid payment method on file with the advertising platforms to prevent campaign interruption.

2.4 Late Payments
We reserve the right to pause all ad management and funnel hosting services immediately if payment is not received by the designated due date.

3. Client Responsibilities and Account Access

To properly deliver our Services, the Client must:

- Provide timely access to ad accounts, business managers, website hosting, pixels, and tracking software.
- Provide high-resolution brand assets, logos, images, and videos unless Legend Marketing is explicitly contracted to create them.
- Review and approve creative copy and designs in a timely manner. Delays in approvals will result in delays in campaign launches.

4. Intellectual Property

Our Property: All materials, tools, templates, and methodologies used by Legend Marketing to create your campaigns remain our intellectual property.

Your Property: Upon full payment of all outstanding invoices, the final funnel designs, custom ad copy, and creative graphics generated specifically for the Client belong entirely to the Client.

Third-Party Assets: Any stock imagery, fonts, or software plugins used in the funnel build are subject to the licensing terms of those respective third-party providers.

5. Performance and Guarantees

While Legend Marketing uses industry-standard best practices, data analysis, and optimization strategies to maximize results, we do not guarantee specific conversion rates, lead volumes, Return on Ad Spend (ROAS), or revenue targets. Paid advertising and digital funnels depend heavily on external market forces, competitive landscapes, platform algorithm changes, and the Client’s own sales close rates and product quality.

6. Termination and Cancellation

Funnel Projects: Setup fees for funnel builds are non-refundable once strategy and copywriting work has commenced.

Monthly Retainers: Either party may terminate a monthly ad management agreement by providing 30 days written notice prior to the next billing cycle, unless a longer lock-in period is specified in your individual Service Agreement.

7. Limitation of Liability

To the maximum extent permitted by law, Legend Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or ad account suspension/banning by third-party platforms (such as Meta or Google) resulting from your use of our Services.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New York State, without regard to its conflict of law provisions.

9. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any material changes by posting the updated terms on this page with a revised effective date.
